2. Website Content Is Indicative, Not Contractual
The content on this website describes the general services Red Lion offers and is intended as an overview for prospective clients. It is indicative only and does not form part of any contract between Red Lion and a client.
All final service engagements, including the specific scope of work, deliverables, pricing, timelines, and responsibilities, will be set out in a written agreement signed by both parties following direct discussion of the client’s property and needs. In the event of any inconsistency between the website content and a signed engagement contract, the signed contract will govern in all respects.
Red Lion makes reasonable efforts to keep the website accurate and current but does not warrant that all information on the site is complete, up to date, or free from error. Website content should not be relied on as a substitute for a formal consultation or signed engagement.
3. Services and Scope
Red Lion provides design, consulting, assessment, inspection & project management services. Red Lion does not perform physical mitigation work. All construction, installation, vegetation clearance, pruning, and hardscape work described in a Red Lion design or inspection report is carried out by independent contractors typically engaged directly by the property owner.
Red Lion is not responsible for the quality, safety, timeliness, or outcome of work performed by third-party contractors engaged by the property owner.
All final service engagements, including the specific scope of work, deliverables, pricing, timelines, and responsibilities, will be set out in a written agreement signed by both parties following direct discussion of the client’s property and needs.
4. No Guarantee of Fire Protection
Wildfire mitigation reduces risk but does not eliminate it. No property can be made fireproof. Red Lion’s services, including risk assessments, design plans, monitoring reports, and consulting advice, are intended to reduce a property’s vulnerability to wildfire based on current standards and best practices, but Red Lion makes no guarantee or warranty, express or implied, that any property will survive a wildfire event.
5. No Insurance Advice
Red Lion is not an insurance broker, licensed insurance agent, or insurance advisor. Documentation provided by Red Lion may support client discussions with insurers, carriers, or the California FAIR Plan, but any insurance decisions, including coverage, pricing, renewal, and claims, should be discussed directly with your licensed insurance broker or carrier. Red Lion does not sell, place, or advise on insurance policies or coverage.
6. Consultations and Bookings
Consultation calls booked through this website are free and typically last 30 minutes. Red Lion reserves the right to reschedule or decline consultations at its discretion. Information shared during a consultation is confidential and will be used only to scope potential engagements and provide follow-up communications.
7. Payment Terms
Specific payment terms, deposit requirements, invoicing schedules, and refund policies will be set out in the signed engagement contract for each client. Unless otherwise agreed, invoices are payable within 14 days of issue. Late payments may incur interest at the maximum rate permitted by California law.
8. Intellectual Property
All content on this website, including text, images, logos, graphics, and the overall design, is the property of Red Lion or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without prior written permission.
Reports, design plans, and documentation prepared by Red Lion for a client are licensed to that client for their own use on the property specified in the engagement. These materials may not be resold, republished, or used for any property other than the one for which they were prepared without prior written consent.
9. Third-Party Content and Links
The website may link to third-party websites or reference third-party resources (e.g., Cal Fire, IBHS, FAIR Plan, Fire Safe Councils). Red Lion does not control, endorse, or take responsibility for the content, accuracy, or practices of any third-party site or resource.
10. Limitation of Liability
To the fullest extent permitted by law, Red Lion’s total liability arising out of or in connection with any engagement, website use, or service provided shall not exceed the fees paid by the client for the specific service giving rise to the claim. Red Lion will not be liable for indirect, incidental, consequential, or punitive damages, including loss of property, loss of income, or loss of use, whether in contract, tort, or otherwise.
Nothing in these Terms limits any liability that cannot lawfully be limited under California law.
11. Indemnification
You agree to indemnify and hold harmless Red Lion, its officers, employees, and representatives from any claim, loss, or expense arising from your misuse of the website, your breach of these Terms, or your engagement of third-party contractors to carry out work described in a Red Lion report or design plan.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of California. Any dispute arising from these Terms or any engagement with Red Lion will be resolved in the state or federal courts located in Solano County, California, and you consent to the exclusive jurisdiction of those courts.
13. Changes to These Terms
Red Lion may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Continued use of the website following any update constitutes acceptance of the revised Terms.
